Terms of Service

1. Introduction

These Terms of Service govern your access to and use of CloakBrowser and related services provided by CloakHQ, a brand operated under PROFITY FINANCE LTD ("CloakHQ", "we", "us", or "our"). By purchasing, subscribing to, or using our software, you agree to these Terms.

2. Our Service

CloakHQ provides software subscriptions for CloakBrowser, a specialized browser environment for developers and technical teams. Our services may include software access, updates, documentation, and support.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, complete, and current information when creating an account or purchasing a subscription.

4. Subscriptions and Payments

Subscriptions are billed according to the plan selected at checkout. Fees, billing cycles, and renewal terms are displayed before purchase. By subscribing, you authorize us and our payment providers to charge the applicable fees.

5. License and Permitted Use

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to use the software for your internal business or technical purposes.

Use of the CloakBrowser binary is also subject to the CloakBrowser Binary License, as published by CloakHQ from time to time.

A paid subscription may provide access to managed services, support, updates, commercial features, account access, or related services. It does not transfer ownership of the software or override the applicable Binary License.

6. Restrictions

You may not copy, resell, redistribute, sublicense, reverse engineer, modify, or create derivative works based on the software except where expressly permitted in writing by CloakHQ. You may not use the software in a way that violates applicable laws, third-party rights, or these Terms.

You may not redistribute, bundle, embed, pre-install, resell, sublicense, or provide CloakBrowser as part of a product, hosted service, browser-as-a-service offering, or service for third-party customers without a separate written OEM/SaaS license from CloakHQ.

You may not assign, transfer, or delegate your rights or obligations under these Terms without prior written consent from CloakHQ.

7. Acceptable Use

You agree not to use the service for unlawful activity, unauthorized access, credential stuffing, brute-force login attempts, automated account creation, circumvention of authentication on systems you do not own or have authorization to test, fraud, identity theft, or unauthorized data collection.

8. Updates and Availability

We may update, improve, modify, or discontinue parts of the service from time to time. We aim to maintain reliable access, but we do not guarantee that the service will always be available, uninterrupted, or error-free.

Updates, patches, new versions, and support may be provided according to the applicable subscription plan, but are not guaranteed unless expressly stated in writing.

9. Intellectual Property

CloakHQ and its licensors retain all rights, title, and interest in and to the software, documentation, branding, and related materials. No rights are granted except as expressly stated in these Terms.

All rights not expressly granted to you are reserved by CloakHQ and its licensors.

10. Termination

We may suspend or terminate access to the service if you breach these Terms, fail to pay applicable fees, or use the service in a way that may create legal, security, or operational risk.

11. Disclaimer

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, CloakHQ will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities arising from your use of the service.

CloakHQ's total aggregate liability for any claim arising out of or relating to the service shall not exceed one hundred US dollars (US $100).

13. Indemnification

You agree to indemnify and hold harmless CloakHQ, PROFITY FINANCE LTD, and their contributors, officers, employees, and partners from any claims, damages, losses, liabilities, and expenses arising from your use of the service, unlawful activity, or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which PROFITY FINANCE LTD is established.

15. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Failure to enforce any provision does not constitute a waiver. These Terms constitute the entire agreement between you and CloakHQ regarding the service.

Refund Policy

1. General Policy

CloakHQ sells digital software subscriptions. Customers may request a refund within 14 days of purchase in accordance with the applicable buyer terms and refund policy.

2. Subscription Billing

Customers are charged at checkout when they subscribe through our website. Subscription renewals are billed according to the selected billing cycle, such as monthly or annually.

3. Cancellation

You may cancel your subscription at any time. Cancellation stops future renewals but does not automatically refund charges already paid. After cancellation, access may continue until the end of the paid billing period unless otherwise stated.

4. Refund Requests
